  Despite this section, licensee may employ a person as a volunteer who does not provide care to children or supervise children if the licensee or the manager has first met with the person and obtained all of the following (c) evidence that the person has complied with the Province's immunization and tuberculosis control programs.

  Observation. Two volunteers did not have evidence of immunization status.

  Corrective action. The director will obtain the immunization status for the volunteers

  Observation. Children were not supervised while playing at the park.

  Corrective action. The manager stated staff will supervise children at all times.

  A Licensee must keep (b) a current record of each person to whom the written agreement is delivered in accordance with that section [CCALA s.19]

  Observation. There was no written record of whom the written agreement was provided to in accordance to CCALA section19.

  Corrective action. Staff said that it may have been forgotten to be documented.

  In respect of a record referred to in this Division, a licensee must (a) keep in a single place at the community care facility the records referred to in sections 56 to 58.

  Observation. No attendance records for children under 5 years old were available on site.This is a repeat contravention.

  Corrective action. Staff said they may be off site for business reasons.

• RECORDS AND REPORTING

  In respect of a record referred to in this Division, a licensee must (c) produce records, on demand, to the medical health officer.

  Observation. Licensing asked to review children's registration packages. Staff said that 4 files might be off-site and could not be produced at the time of inspection.

  Corrective action. Staff said that the files will remain on site in the future.

  A licensee must keep (b) in any other case, all criminal record check results and character references for the entire time that the subject of the criminal record check or character reference is ordinarily present on the premises.

  Observation. One individual who had been working on the premise for 1 month did not have a Criminal record on site.

  Corrective action. Staff said he must follow up on the application.

  Observation. Upon asking to review the attendance records for the previous 4 months, the licensee said that they were not on site.

  Corrective action. Please ensure records referred to sections 56 to 58 are kept at the facility.

• A licensee must ensure that children are supervised at all times by a person who is an educator, an assistant or a responsible adult.

  Observation. Child A was unsupervised while exiting the personal residence of the Licensee and entering the childcare facility.

  Corrective action. Please ensure children in care are supervised at all times.

  A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.

  Observation. Upon inspection the back yard had broken cedar fence panels that were being held up by 4x4's. The Manager said that she takes the children to the park.

  Corrective action. Please ensure the on site play space is enclosed safely and is free from harm.

  Observation. Upon asking the Manager to provide the emergency supplies to be inspected, she said that she could not get them.

  Corrective action. Please ensure emergency supplies are accessible.

  A licensee providing a care program to any child younger than 36 months of age must provide a separate sleeping area located away from any activity area.

  Observation. Upon inspection, the nap room was being used as storage. A child younger than 36 months was present.This is a repeat contravention.

  Corrective action. Please ensure that a separate sleeping area, away from any activity, is provided for children younger than 36 months.

  Observation. Upon asking the manager to see the center's emergency supplies twice, the manager did not produce them and said "I don't know"

  Corrective action. Please ensure that staff are aware of emergency procedures and can produce supplies to prepare for, mitigate, respond to and recover from any emergency.

  Observation. Upon review of the children's records, one file did not have a start date recorded.

  A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry.   Observation. Upon review of the staff files, 2 staff did not have their Licences verified.

  Corrective action. Please ensure staff files are complete.

  A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child. Observation (CORRECTED DURING INSPECTION): Hand sanitizer was accessible to children at the entrance to the facility and in the nap room.

  Corrective action. The hand sanitizer was moved out of children's reach during this inspection.

• EQUIPMENT AND FURNISHINGS

  A licensee providing a care program to any child younger than 36 months of age must provide a separate sleeping area located away from any activity area.

  Observation. The nap room is set up as a learning room for school age/older children. The amount of furniture/equipment does not make the room accessible for napping.

  Corrective action. The nap room needs to be accessible to children at all times.

  A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance. Observation (CORRECTED DURING INSPECTION): CCFL observed the following: A hole in the netting on a playpen used for napping and particle board was exposed and warping on one of the cupboard doors under the bathroom sink.

  Corrective action. The crib was removed during this inspection and the exposed particle board was covered with duct tape.

• STAFFING

  A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.

  Observation. Two persons living at this address do not have valid criminal checks.

  Corrective action. Please ensure all persons age 12 years and older who live at this address have a valid criminal record check. This is repeat non-compliance.

• STAFFING

  A licensee must ensure that children have at all times immediate access to an employee who (a) holds a valid first aid and CPR certificate, provided on completion of a course that meets the requirements of Schedule C.

  Observation. The managers first aid certification expired on September 17, 2019. There are times when the manager drives children.

  Corrective action. If the manager is alone with children he needs to have a valid first aid certificate.
