Observation. - The annual practice of the large scale evacuation plan is not recorded. *Correct by: December 19, 2025.* - The monthly fire drill record does not include evidence that a drill was practiced in November 2025. *Correct by: December 12, 2025.* The record of fire drills and the record of the evacuation plan practice are part of the Licensee's fire drill system that has been approved as defined in section 2.8.3 of the BC Fire Code. In order to ensure that fire drills and the evacuation plan are practiced as required, the records must be kept up to date. The required policies and procedures are in place and appear satisfactory. The evacuation kit is complete with adequate emergency supplies as per the Licensee's evacuation plan.

To ensure that the staff have immediate access to the children's personal information in the event of an emergency situation and/or evacuation, this information must be complete and up to date. *Correct by: December 12, 2025.* Other records such as the daily attendance, minor incident log, and the play space inspection log are up to date and appear satisfactory.

Observation. Based on the information gathered during this inspection, as well as the incident report that was submitted to Licensing on April 2, 2025 by the Licensee prior to the inspection, the investigating LO has determined the following allegation listed in both complaints is substantiated: 1. CCLR, Section 34(2)(b) - Group sizes and employee to children ratios - Substantiated. The investigating LO confirmed with the manager that the required staff to child ratio was not maintained in the Group Child Care (Under 36 Months) program for approximately two hours on April 1, 2025. This type of incident is defined in the CCLR as a "service delivery problem". As per the incident report that was submitted to Licensing on April 2, 2025, the Licensee listed follow-up actions to address the incident. As a result of this finding, the Licensee is required to submit to Licensing on or before April 11, 2025, a detailed written plan which addresses (1) How the Licensee has corrected the identified contravention and (2) The system the Licensee has implemented for ongoing monitoring of the identified contravention, thus ensuring sustained compliance at all times. During the inspection, the LO reviewed the daily attendance records and questioned the program staff about the average number of children attending the program each day and which staff regularly work in the program. At the time of the inspection, there were 7 children present with 1 Infant and Toddler Educator (ITE), 1 Early Childhood Educator (ECE), and 1 Early Childhood Educator Assistant (ECEA). The attendance records showed that there was an average of 9 children attending the program on a daily basis and that there were 2 or 3 qualified staff regularly working in the program as required.

Observation. - The Licensing Officer observed a new washer/dryer combo fixed appliance installed in the Group Child Care (Under 36 Months) program room. Licensing was not notified of this change to the floor plan prior to this fixed appliance being installed. The installation of a fixed appliance impacts the total useable space in the Group Child Care (Under 36 Months) program. - Some staff Early Childhood Educator (ECE) and Early Childhood Educator Assistant (ECEA) certificates were not displayed in the facility as required. - *This contravention was resolved during the inspection. The Licensing Officer observed other documents such as the facility licence and the name of the manager posted in the facility as required.
- C3.2 - Are persons qualified and appropriately replaced?Critical
Observation. - Upon review of the staff files, the Licensing Officer identified that there was no evidence that the Licensee had validated the ECE and ECEA staff certificates.
- C7.2 - Is there adequate and appropriate indoor and outdoor space, materials, and equipment?Critical
Observation. - The Licensing Officer observed a new washer/dryer combo fixed appliance installed in the Group Child Care (Under 36 Months) program room. This appliance measured a total of 6.25 sqft. After this inspection, the Licensing Officer and the manager reviewed previously submitted floor plans with measurements and confirmed that due to the size of the fixed appliance, there was not enough useable space for the capacity of 12 children.

Observation. - The record of monthly fire drills was not displayed in the facility as required.
- C3.1 - Does the facility have sufficient employees who possess adequate training and experience to meet the care, supervision, and needs of the children?Non-critical
Observation. - Since the facility is located on First Nations land, the Licensee is required to obtain evidence that their employees have been screened for tuberculosis. - *The correction date for this contravention is February 28, 2025.
- C7.1 - Is the facility safe, sanitary, free from hazards, in good repair, and appropriate for the age and development of children?Non-critical
Observation. - The Licensing Officer observed an open closet that stored the facility security/camera electrical system. This system, with hanging cords attached, was accessible to the children in care. - There was no system in place to monitor the fridge temperature in the Group Child Care (Under 36 Months) program room. This fridge is used to store the children's bottles. - In one of the Group Child Care (30 Months to School Age) rooms, the Licensing Officer observed children's lunches, that contained meat and other food requiring refrigeration, stored on a shelf. The Licensing Officer did not observe a system in place to prevent food borne illness. - In one of the Group Child Care (30 Months to School Age) rooms, the Licensing Officer observed hazardous products stored under the kitchen sink which were accessible to the children in care. - In the Group Child Care (Under 36 Months) program room, the Licensing Officer observed play equipment and other toy items stacked and stored right next to one of the toilets used by the children in care. These toy items could tip over or be pulled down on top of a child while they are sitting on the toilet. - A 6 inch depth of resilient material must be maintained under the fall zone areas of climbing equipment that is over 5 ft in height. Maintaining the 6 inch depth of resilient material also applies to underneath swings. - The Licensing Officer observed some supplies in the first aid kits that were expired.

Observation. During the inspection, the Licensing Officer observed the following contraventions: • Some child records were missing required information such as doctor or medical clinic contact information, care card number, immunization status, and emergency contacts other than the parents. • Some child records were missing a current photo of the child that can be used to readily identify the child in the event of an emergency. • Some care plans in place for children requiring extra support were inadequate as they did not include evidence that the plan had been developed and maintained by the Licensee. • The Licensee's system for logging outside play space inspections was not maintained as required. Other record keeping systems such as the daily attendance records and minor incident logs were reviewed by the Licensing Officer and they appeared satisfactory.

Observation. - In the outdoor play space, the Licensing Officer observed a climbing toy that did not have the required 6 feet of clearance. As the space is too small for this toy it will need to be removed. - The Licensing Officer observed tall storage shelves in the program rooms to be secured to the wall. - In the outside play yard, the sand in the sandbox was replenished. - In the outside play space the large dividers that were observed leaning against the building are now secured to the fence eliminating the risk of falling on the children.

Observation. At the time of the inspection the Licensee was awaiting a final building inspection, which must be received before Licensing can issue a licence.

Observation. At the time of the inspection, a diaper changing station was observed in the classroom as not providing privacy to a child that may be being changed. Since the inspection the Licensee placed a divider by the change station to block the view of others.

Observation. • In the outside play yard, the Licensing Officer observed a small climber that needed repairs to the attached green slide and some of the equipment joints were loose.

Observation. • The Licensing Officer observed hazardous products and objects that were accessible in one of the proposed Group Child Care (30 Months to School Age) program rooms. • The Licensing Officer observed tall storage shelves in the program rooms that showed a risk of tipping. • In the outside play yard, the sand in the sandbox was depleted. • The Licensing Officer observed climbing equipment in the outside play yard that did not have a 6 ft clearance around it to ensure safe entering and exiting of the equipment. • The Licensing Officer observed large dividers leaning against the wall of the building in the outside play yard. Safe storage of these dividers was needed. • The Manager informed the Licensing Officer that curtains will be installed for the sleeping areas to be kept separate. The Licensing Officer and the Manager discussed the need for additional age appropriate furniture such as high chairs and toddler specific toys, etc., in the applicable program rooms.

Observation. The installation of a fire door that separates the current facility on the main level of the building from the upper floor was in progress. Confirmation that the building inspector has approved the renovations to the facility has not yet been received. The Licensee must contact the fire department of West Kelowna directly to arrange for a fire inspection for a facility on First Nations Land.

Observation. The Licensing Officer observed a diaper changing station in the proposed Group Child Care (Under 36 Months) room. • The Licensee must provide a sturdy surface for changing diapers in the Group Child Care (30 Months to School Age) program rooms.

Observation. During the inspection, the Manager confirmed to the Licensing Officer that a reportable incident had occurred on May 30, 2024. The incident involved the malfunctioning of all 7 toilets within the licensed facility for approximately and hour to a hour and a half. The toilets could not be flushed due to a main blockage which impacted the normal operation of the licensed programs. This incident was not reported to Licensing as required by Section 55 (2) of the Child Care Licensing Regulation. This unexpected event was determined to be a "service delivery problem" as defined in Schedule H - "Reportable incidents" of the Child Care Licensing Regulation (CCLR). Based on the information gathered during this complaint investigation, the Licensing Officer has determined that the complaint allegation was substantiated.

Observation. - Ensure the record of monthly fire drills is displayed in the facility as required. - Ensure that adequate supplies, such as non-perishable food and water, are available in the evacuation kit as per the facility's emergency evacuation plan.

Observation. - Child records were missing the name and phone number of a medical practitioner/clinic and care card numbers. - As per Section 58 of the Child Care Licensing Regulation, care plans must be developed for children who meet the definition of "child requiring extra support". These care plans must be kept at the facility. The LO and the manager discussed the Licensee's system for logging minor incidents and ensuring that staff include specific information in the minor incident record such as the correct date/year, details of what happened, the location of the injury on the body, etc.

Observation. - The hot water temperature at the sinks used by the children measured at 60C during the inspection. Ensure the hot water temperature does not exceed 49C.

Observation. - Staff files were missing evidence of character reference checks. - Written documentation (e.g. formal letter) from the Supported Child Care agency, for supported child care staff working in child care facilities but who are not directly employed by the Licensee, must be provided to the Licensee certifying that the support staff has completed all of the required documentation as listed in Section 19 of the Child Care Licensing Regulation. The letter must also include the location of the completed documents and the letter must be kept at the facility for review by Licensing. The criminal record check referred to in Section 19 must be from the Criminal Records Review Program in Victoria, BC. A RCMP check for a support staff person is NOT accepted.
