- The licensee must not permit a person over the age of 12 to be ordinarily present on the premises of a community care facility while children are present, unless the person is of good character and the licensee has obtained a criminal record check for that person.
Observation. This violation is being carried over from the January 17, 2023, Routine Inspection. During the January 17, 2023, Routine Inspection it was observed that the Criminal Record Checks for the Licensee Contact and Manager had expired on December 21, 2022. Licensee Contact and Manager had received criminal record check results through an online company. After consultation with the Criminal Record Review Program (CRRP), it was confirmed that the criminal record checks did not meet legislative requirements. This was reviewed with Licensee Contact in email exchanges, starting on January 31, 2023, as well at in person Follow Up Inspections on April 27 and September 12, 2023. Licensing offered options of applying to the CRRP directly, coming to the Licensing office, or filling out forms that Licensing Officers brought to the facility. On November 1, 2023, Licensing received an email from Licensee Contact stating that applications for criminal record checks had been submitted to the CRRP. The CRRP stated that they had no records of applications for Licensee Contact or Manager. At this inspection the criminal record check results had not been received. Licensee Contact stated he will be completing the online application this week.
Corrective action. Ensure people ordinarily present have a current criminal record check.
