Observation. The investigating Licensing Officer and the supporting Licensing Officer arrived at the premises on February 12, 2025, at 3:10pm. While standing at the glass entrance doors, the Licensing Officers witnessed two of the operator's employees and 9 children present in the room. The Licensing Officers observed the children sitting at tables engaging in what appeared to be art activities. The Licensing Officers also observed a folding half divider in place that appeared to separate the large open room into two spaces. One side of the room had tables, chairs, and what appeared to be art supplies. The other side of the room had a climbing frame, toys, and a basketball hoop. One of the operator's employees opened the door and explained that they were instructed by the operator not to let Licensing into the premises unless the operator was present. The operator was not present at the time of the inspection. While the Licensing Officers stood at the door, the operator's employee stated that up until that day, the children attending the program had only been doing art activities. The operator's employee further explained, however, that since it had been an early dismissal day from school, they had been instructed by the operator to allow the children to do other activities and play with other toys and equipment on the “play side” of the room. The investigating Licensing Officer informed the employee that documentation from the follow-up visit would be completed and forwarded to the operator. The Licensing Officers left the premises at 3:22pm. At no time did the Licensing Officers enter the premises. At 4:05pm on February 12, 2025, the Licensing Officers arrived back at the premises to provide the employees with the handwritten follow-up inspection report. The Licensing Officers knocked on the entrance door multiple times to deliver the report. The Licensing Officers witnessed the same two employees present in the room as well as 3 children throwing balls into a basketball hoop on the "play side" of the room. Since the Licensing Officers witnessed the children present engaged in an activity other than art, the program operated after school by the operator does not meet the requirements as outlined in Section 3 “Certain programs exempted” of the CCLR. Neither employee came to the door to accept the report. The Licensing Officers left the premises at 4:13pm. Based on the observations made by the Licensing Officers and the information the operator's employee provided during the follow-up inspection, the investigating Licensing Officer established that the operator was still acting in contravention of the Community Care and Assisted Living Act (CCALA) and that the operator was not adhering to their written compliance plan of January 10, 2025. During the inspection, the Licensing Officers witnessed the children present engaged in an activity other than art. Therefore, the program operated after school by the operator did not meet the requirements as outlined in Section 3 “Certain programs exempted” of the CCLR. Immediate compliance to Section 5 of the Community Care and Assisted Living Act is required. Written confirmation of compliance must be submitted by the operator to LicensingDirect@interiorhealth.ca by Wednesday February 19, 2025 at 4:00pm. Failure to maintain compliance with the Act may compel Interior Health to take further enforcement action against the operator.

Observation. No. The investigating Licensing Officer conducted an unannounced inspection of the premises on a school day (December 18, 2024) between 3:15pm and 4:10pm. The Licensing Officer explained the purpose of the unannounced visit to the operator's employees who were present, including the nature of the allegations, and the sections of the Community Care and Assisted Living Act (CCALA) that apply. One of the operator's employees signed the consent to inspect form and permitted the Licensing Officer (LO) to enter the premises. The Licensing Officer observed seven school age children in the care of the operator's employees. During the inspection, the children were observed engaging in activities such as snack time, an art/craft activity, playing with toys, playing tabletop games, and climbing on gross motor equipment that was available in the room. The employees confirmed to the LO that none of the children were related to them by blood or marriage. The Licensing Officer determined that the facility being operated met the definition of "community care facility" as per Section 1 "Definitions" of the CCALA and the program being provided to the children met the definition of a Group Child Care (School Age) program as per Section 2(1)(d) of the Child Care Licensing Regulation (CCLR). The program and activities offered did not meet the requirements as outlined in Section 3 “Certain programs exempted” of the CCLR and, therefore, requires a community care facility licence. The Licensing Officer reviewed the findings with the operator's employees and a hand written inspection report was provided to them. The employees stated that they would provide the written inspection report to the operator as soon as possible following the inspection. Immediate compliance to Section 5 of the Community Care and Assisted Living Act is required. Written confirmation of compliance must be submitted by the operator to LicensingDirect@interiorhealth.ca by Thursday December 19, 2024 at 12:00pm.
