- STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation. Licensing reviewed 5 staff files and 1 staff file contained a valid criminal record clearance letter addressed to another agency.
Corrective action. The Manager said CRC has been shared through the CRRP sharing program and a copy of the CRC results will be kept in the staff file.
12040 - CCLR s.19(1)(a) - STAFFING
A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation) Observation (CORRECTED DURING INSPECTION): One staff's ECEA certificate was not validated through the ECE Registry. Manager validated the staff's certificate during inspection.
Corrective action. Manager said the validation results will be printed and kept in staff's file.
12140 - CCLR s.19(4)(a) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation. Licensing reviewed 5 staff files and observed 2 files were missing immunization status. The Manager said that 2 staff have this information, but it is kept off-site.
Corrective action. The Manager said this information will be added to the staff files.

Observation. Evidence of reference checks was not available for 4 staff members. The Manager said that references were contacted, but the notes of the checks are kept off-site.

- EQUIPMENT AND FURNISHINGS
A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees. Observation (CORRECTED DURING INSPECTION): The fridge temperature was measured at 6.9 degrees Celsius
Corrective action. Please ensure that the fridge temperature is kept between 0-4 degrees Celsius for safe food storage.Manager corrected this during inspection.
11010 - CCLR s.13(1) - EQUIPMENT AND FURNISHINGS
A licensee must ensure that the community care facility and the furniture, equipment and fixtures within it are clean and in good repair while children are in attendance.
Observation. During inspection Licensing observed : -There are various sections of the wall where the paint has started to peel. -Throughout the facility the lower sections of the walls and cupboard surface area at children level are in need of cleaning. -In the bathroom the baseboards had excessive build up of dust particles and the lower wall area had visible dirt and water stains -Lids of the garbage cans in the classroom had dried up food substances and stains on them -Few bins used for toys have a build up of dust and dirt particles in them. - Coils inside one of the baseboard heater is accessible to the children. Licensing was concerned that children can get hurt if they put their hands inside it. Maintaining a general cleanliness of the facility was discussed with the Manager.
Corrective action. Please ensure facility is clean and in good repair.
11020 - CCLR s.13(2) - LICENSING
A licensee must display in a prominent place in the community care facility both the licence, including any terms or conditions of the licence, and the name of the manager. Observation (CORRECTED DURING INSPECTION): During inspection licensing observed that Manager's name was not posted in the facility. This was corrected during the inspection.This is a repeat contravention from # SMIA-C4EQU2 dated 25 June 2021.
Corrective action. Please ensure that managers name is posted in a visible location in the facility.
10050 - CCLR s.11(1) - POLICIES AND PROCEDURES
A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation. On inspection the Licensing Officer observed expired food & water in the emergency supply kit and not enough supplies for 72 hours.This is a repeat contravention from routine inspection # SMIA-C4EQU2 dated 25 June 2021 and # SMIA-CGXLFN dated 2 Aug 2022.
Corrective action. Please ensure there are enough emergency supplies for all children for up to 72 hours and that all supplies have a current expiration date.
13020 - CCLR s.22(1)(b) - RECORDS AND REPORTING
A licensee must have in writing from a parent, and maintain at the community care facility, consent (a) to call a medical practitioner or ambulance in case of accident or illness if the parent cannot immediately be reached.
Observation. 5 Children's files were reviewed and one child's file was missing consent to call a medical practitioner or an ambulance in case of accident if the parent cannot be reached immediately.
Corrective action. Please ensure children's files are complete before they start attending the program
19190 - CCLR s.57(3)(a) - RECORDS AND REPORTING
A licensee must keep, for each child, a record showing the following information: (a) name, sex, date of birth, medical insurance plan number and immunization status.
Observation. Files of 5 children were reviewed. Immunization status of one child was missing.
Corrective action. Please ensure children's files are complete before they start attending the program.

A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation. Licensing reviewed 4 staff files and 1 staff file contained a valid criminal record clearance letter addressed to another agency.

The licensee must (b) review the care plan at least once each year with a parent of the child requiring extra support and any person requested by the parent.
Observation. Licensing observed that a care plan for one child had not been reviewed within the past 2 years. This is repeat contravention from follow-up to routine inspection # KTOR-BSMTSN 18 August 2020.
Corrective action. Please ensure care plans are reviewed at least once every 12 months with a parent of the child requiring extra support and any person requested by the parent.
19260 - CCLR s.58(2)(b) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation. The Licensing Officer reviewed four staff files and observed the following: - 1 staff file did not have a criminal record check and the other staff person does not have a CRC completed through the criminal record review agency in Victoria. This staff person currently has a clear criminal record check from the RCMP on file at the facility. Any staff who do not have a criminal record check or have an expired one, cannot work alone with children until they obtain one.
Corrective action. Please ensure all staff persons have a criminal record check through the criminal records review branch in Victoria

Corrective action. The Manager must verify ECE/ECEA certificates through ECE Registry website and keep evidence of this verification in staff’s file. 19320 - CCLR s.59(a) - RECORDS AND REPORTING
A licensee must keep, for each child, a record showing the following information: (h) any special instruction respecting the child's diet, medication, participation in a program of activities, or other matter relevant to the child's care, (i) given by the child's parent to the licensee in writing.
Observation. One child’ file was missing written instructions on medication that child takes daily at the facility.Staff were abe to explain the instructions verbally.
Corrective action. Ensure that child’s records include special instruction regarding the child's medication given by the child's parent to the licensee in writing.
