A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation. Licensing observed that the fire extinguisher had not been serviced annually.
Corrective action. Please ensure systems are in place to ensure that the facility is prepared to respond to an emergency.
13020 - CCLR s.22(1)(b) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation. Licensing observed two out of three files reviewed were missing site specific CRC's. They did have CRC's from a previous employ. Manager said that they have been applied for with the CRRP. This is a repeat contravention.
Corrective action. Please provide a health and safety plan to mitigate the risk to children when addressing this contravention.

A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation. Licensing reviewed six staff files. One file did not have criminal record check in place. This staff is on site today.
Corrective action. Please ensure all staff files are complete, including criminal record check. This staff must not work alone. Please provide a health and safety plan to licensing.

A licensee must do all of the following: (b) operate the community care facility in a manner that will promote (i) the health, safety and dignity of persons in care,
Observation. Licesning observed a napping child in the downstairs nap room, that was occasionally checked on by staff while the rest of the group were outside. The nap room door was open along with the bathroom door, in which the cupboard door was unlocked. This cupboard held hazardous materials such as Clorox and laundry detergent. This poses a risk of harm to the children in care.
Corrective action. Please ensure that the facility is operated in a safe manner, mitigating any risk to the children in care.
11480 - CCALA s.7(1)(b)(i) - OR SUPERVISION
Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation. In conversation with the staff, Licensing learned that the opening staff did not have the required qualifications as per Schedule E until the substitute staff arrived at lunchtime. Appropriate staff qualifications were discussed at the routine inspection as being a concern, and was addressed in the response to Licensing.
Corrective action. Please ensure staffing qualification meet the requirements of Schedule E at all times. Please provide a compliance plan to Licensing.
14030 - CCLR s.34(2)(b) - STAFFING
A licensee must not employ a person in a community care facility as (a) an educator or an assistant unless the person holds a certificate issued under Division 2 [Employee Qualifications], which must be verified by the system maintained by the early childhood educator registry. (Educator or assistant certificate validation)
Observation. On review of staff files, Licensing observed that one staff file who was ECE certified, was missing validation.
Corrective action. Please ensure staff files are complete
12140 - CCLR s.19(4)(a) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation. On review of staff files, Immunization status was not obtained for one employees.
Corrective action. Please ensure all staff files are complete.

A licensee must keep current records of each of the following: (b) for each employee, the records required under section 19 (1) [character and skill requirements].
Observation. Licensing observed that an Agency staff on site today did not have documentation of the requirements of Section 19 on site. Staff did say that all documents had been provided to the Manager but Licensing was unable to locate this information. Staff did provide a copy of most required documents held on a digital device, but no copy of CRC.
Corrective action. Please ensure all documentation for each employee is available for review on site at all times when employee is present. Please submit a compliance plan as to how this will be addressed.

Observation. Licensing observed that the Manger name was not posted - this was further discussed as to the intent of legislative requirement.
Corrective action. Please ensure the Manager name is prominently displayed.
10050 - CCLR s.11(1) - OR SUPERVISION
A licensee must ensure that children are adequately supervised by qualified employees in sufficient numbers to meet the needs of each child.
Observation. In discussion with staff, Licensing observed that on occasion, a second staff supervises children off site and does not hold the qualification of ECE certification as required by Schedule E.
Corrective action. Please ensure that any staff solely caring for children meet the requirements of the service type in Schedule E. Please provide a compliance plan to Licensing.

Observation. Through review of attendance records, Licensing observed that on at least 4 occasions in January, capacity was exceeded. In discussion with the Manager, it was identified that a second staff was caring for some children off-site until capacity was reduced to accommodate them at the facility. This was further discussed.
Corrective action. Please ensure that enrolment and attendance meets the approved capacity of the community care facilities licence at all times. Please provide a compliance plan to Licensing.
14360 - CCALA s.7(1)(b)(i) - POLICIES AND PROCEDURES
A licensee must: (b) have an emergency plan that sets out procedures to prepare for, mitigate, respond to and recover from any emergency.
Observation. Licensing observed that the fire extinguisher did not indicate last date of service. Extinguishers must be serviced annually or a receipt displayed as to purchase date of the extinguisher if within the last year. Facility policy also did not provide an alternate location for evacuation. This was further discussed. The Manager is also aware that the annual evacuation drill is required to be completed in the first year of operation.
Corrective action. Please ensure there is an appropriate plan in place with available resources in case of an emergency and provide a compliance plan to Licensing.

A licensee must keep, for each child, a record showing the following information: (b) date of enrolment in the community care facility.
Observation. On review of 3 children's files, Licensing observed that all 3 did not contain an enrolment date.
Corrective action. Please ensure children's files are complete at the time of registration

A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation. Copies of any diplomas, certificates or other evidence of the person's training and skills were not obtained for two staff, out of the 3 staff files reviewed.
Corrective action. Please ensure all staff documentation is in place prior to the staff working on site

Observation. On review of 3 staff files, Licensing observed that the Manager only had 2 references where the requirement is 3, and 1 other staff did not have references on file. Both staff were on site today.
Corrective action. Please ensure staff files are complete prior to employment at the facility
