- Without limiting subsection (1), a licensee must ensure that (a) children attending a community care facility are divided into groups, with each group having no more children than that permitted in Schedule E.
Observation. The maximum capacity of the facility in the GCC Under 36 Months program was exceeded.
Corrective action. The manager will ensure that the maximum capacity of the facility is not exceeded.

- OR SUPERVISION
Without limiting subsection (1), a licensee must ensure that (b) the ratio of employees to children attending a community care facility is no less than that permitted in Schedule E.
Observation. When the Licensing Officer arrived at the facility, one ECE staff was alone with six children. The staff said the Licensee Contact had been gone for about one hour. This is not allowed as no more than four children are allowed per staff. The Licensee Contact arrived at the facility during the inspection and said she knew that she should have not left one staff with six children.
Corrective action. The Licensee Contact said that she will ensure that the child to staff ratio is in compliance with the legislation at all times and will not leave the facility unless there is adequate staffing.

- EQUIPMENT AND FURNISHINGS
A licensee must ensure that a healthy and safe environment is provided at all times while children are under the supervision of employees.
Observation. An upright piano has been placed in the main play room. Foam that covers some of the sharp edges of the piano is falling off and there are also sharp edges that have not been covered that are at child height.
Corrective action. The Licensee Contact said she will ensure all sharp edges of the piano are covered in foam that is securely attached.
11010 - CCLR s.13(1) - EQUIPMENT AND FURNISHINGS
A licensee must ensure that the entire outdoor play area is (a) enclosed in a manner that is suitable for the age and development of children, and will ensure that children are free of harm.
Observation. Two metal supports on the backyard outdoor play are have sharp edges accessible to children.
Corrective action. The Licensee Contact will ensure children do not have access to these sharp edges.
11160 - CCLR s.16(3)(a) - EQUIPMENT AND FURNISHINGS
A licensee must ensure that children do not have access to any object or substance that may be hazardous to the health or safety of a child.
Observation. At times children have their hands washed at the kitchen sink. Bleach spray, dish soap and windex are accessible to children at this sink.
Corrective action. The Licensee Contact will ensure that children do not have access to these products.
11200 - CCLR s.17 - LICENSING
Applicants for licences and licensees must notify a medical health officer immediately of any change in the information provided under section 9.
Observation. An area of the backyard has been fenced and is being used for outdoor play and Licensing had not been informed of this. This space was not included in the site plan submitted with the application for licence.
Corrective action. The Licensee Contact will submit an updated site plan which includes the area of the backyard that they would like children to use.
10010 - CCLR s.10(1) - RECORDS AND REPORTING
A licensee must keep, for each child, a record showing the following information: (i) a photograph or digital image of the child, and other information that can be used to readily identify the child in an emergency.
Observation. Photos were not available for any of the children.
Corrective action. The Licensee Contact said she will ensure a photo is available for all children.
19160 - CCLR s.57(2)(i) - RECORDS AND REPORTING
A licensee must keep, for each child, a record showing the following information: (c) daily attendance record, indicating for each day whether the child is absent or, if the child is present, the time of arrival and departure.
Observation. The app used to record time in and out does nor record time. Although a hard copy of time in and out is also kept, this was not completed for any children on June 10th and 11th.
Corrective action. The Licensee contact will ensure staff use the paper time in/out sheet to record times as well as using the app.
19090 - CCLR s.57(2)(c) - RECORDS AND REPORTING
A licensee must keep, for each child, a record showing the following information: (d) name and telephone number of a parent, medical practitioner and emergency contact.
Observation. Files for six children were reviewed. Contact information. for a doctor or medical clinic was unavailable in one file and contact information for an emergency person was unavailable in another file.
Corrective action. The Licensee Contact will ensure all children's files contain the required information.
19100 - CCLR s.57(2)(d) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (d) copies of any diplomas, certificates or other evidence of the person's training and skills.
Observation. A file for one staff was not at the facility and evidence of the person's training was not available.
Corrective action. The Licensee contact will ensure an certificate is available for all staff.
12070 - CCLR s.19(1)(d) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (f) evidence that the person has complied with the Province's immunization and tuberculosis control programs.
Observation. A file for one staff was not avaible and immunization status was not obtained for one or more employees.
Corrective action. Teh Licensee Contact will ensure immunizatiosn status is avaialbe for all staff.
12090 - CCLR s.19(1)(f) - STAFFING
A licensee must not continue to employ a person in a community care facility unless the licensee has evidence that the person continues to comply with the Province's immunization and tuberculosis control programs.
Observation. A file fro one staff was not at the facility and evidence of immunization status was not available.
Corrective action. The Licensee Contact will ensure evidence of immunization status is available for all staff.
12170 - CCLR s.21(1) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (a) a criminal record check for the person.
Observation. Criminal record checks were not available for two staff. Staff must have a valid criminal record check before they start work.
Corrective action. The Licensee Contact will ensure all staff have a valid criminal record check before they start work.
12040 - CCLR s.19(1)(a) - STAFFING
A licensee must not employ a person in a community care facility unless the licensee or, in the case of a person who is not the manager, the manager has first met with the person and obtained all of the following: (b) character references in respect of the person.
Observation. A file for one staff member was not at the facility evidence of character references was not available.
Corrective action. The Licensee Contact will ensure references are available for all staff.
